BOOKING CONDITIONS
Tupasluikka Ltd. applies the following terms and conditions to the ordering and booking of cottage holiday services as well as to the cancellation of booked services. These terms and conditions become binding to both parties once the client has paid the deposit mentioned in these contract terms to Tupasluikka or paid both the deposit and the final installment together.
TERMS OF BOOKING AND PAYMENT
The booking is confirmed once the customer has paid the deposit (30% of the cottage rent) or once the customer has paid both the deposit and the final installment together. The final installment must be paid no later than five (5) weeks prior to the start of the holiday. If the booking is made less than five (5) weeks before the start of the rental period or if the cottage is booked for less than seven (7) days, the full sum must be paid immediately on booking. If the client fails to pay or misses the payment deadline, the booking will be cancelled without further notification.
CANCELLATION OR CHANGE OF BOOKING
Any cancellations must be made to Tupasluikka in writing (by letter, e-mail). The date on which Tupasluikka receives the notification will be regarded as the date of cancellation. Should the client be able to prove that the cancellation was made and sent to the right address at the right time, a cancellation may be accepted despite late arrival or failure to arrive.
In the case of a cancellation is made more than 28 days before the start of the stay, the deposit and the final installment except the cancellation fee €50, will be returned to client.
If the cancellation is made less than 28 days before the start of the stay, the deposit and the final installment will be retained as a cancellation fee.
Regardless of the above, all sums with the exception of the deposit paid to Tupasluikka will be refunded if the client or a person from the same household falls seriously ill, has an accident or dies. In this case, Tupasluikka must be informed immediately of the cancellation, which must be properly verified by, for example, a doctor’s certificate. If the cancellation is made during the holiday, payments already made by the client will not be refunded.
All changes must be made at least eight (8) weeks before the start of the stay. Any changes made after this date will be treated as a cancellation of the previous booking and a subsequent new booking.
RIGHT OF TUPASLUIKKA TO CANCEL A BOOKING
Tupasluikka may cancel a booking in the event of force majeure. In this case, the client is entitled to a full refund of the sum paid to Tupasluikka. If the customer fails to pay or misses the payment deadline, the booking may be cancelled without further notification.
KEYS TO THE COTTAGE AND JANITORIAL SERVICE
The keys to the cottage will be handed over to the client at the time of arrival as estimated by the Ylläspalvelu - ANT-Tilat Ky address Vaeltajantie 2 A, 95980 Ylläsjärvi (Tel. +358 400 774 757). The owner or custodian is entitled to charge a deposit against the loss of the keys. If the client fails to return the keys and their loss can be attributed to the client’s negligence, the actual cost of replacing the cottage’s locks less any deposit will be charged. In the possible janitorial service needs shall client contact ANT-Tilat Ky.
STAY AT THE COTTAGE
In the case of a one-week stay, the cottage will be at the client’s disposal from 16.00 (4 pm) on the day of arrival (Saturday) to 11.00 (11 am) on the day of departure (Saturday). In the case of a three- or five-day stay, the cottage will be at the client’s disposal from 16.00 (4 pm) on the day of arrival to 11.00 (11 am) on the day of departure.
The keys to the cottage will be handed over to the client at the time of arrival as estimated by the key service and notified to the cottage owner or custodian by phone or in writing. The keys of the cottage should be returned to the key service by the time of departure.
The cottage rent covers the furniture, cooking and eating utensils, firewood and the cleaning after departure.
The client is entitled to bring own sheets and towels. It is possible to rent sheets and towels when booking the cottage á €25/person.
The client is responsible for cleaning the cottage during the rental period.
The client must follow the instructions given on the use of the cottage. The instructions can be found in the Manual folder. At the end of the rental period the client must act according to the checklist.
The number of people using the cottage must not exceed the number of sleeping places stated in the description or the number agreed on during booking. The year of birth is asked from every person when booking the cottage.
Pets and smoking are not allowed in any case.
COMPENSATION FOR DAMAGE AND FORCE MAJEURE
The client will be required to pay to Tupasluikka direct for any damage caused to the cottage or its contents during occupancy. The cottage and its furniture and equipment are checked after each rental period. Inappropriate damages (stearin damages, strong food stains, unwashed dishes, sticky floors, vomit) will be charged separately.
Tupasluikka will be entitled to charge the client a supplementary cleaning fee €1000 for smoking or having pets in the cottage.
Tupasluikka will not be liable for any damage or inconvenience incurred by the client in the event of an unpredictable and insurmountable obstacle (force majeure) or some other comparable reason, such as a natural phenomenon, power failure, etc., that was not caused by Tupasluikka and that Tupasluikka could not with all due reason foresee. Neither is Tupasluikka responsible for any damage or inconvenience caused by regular natural phenomena.
RESCISSION OF THE AGREEMENT IN CASE OF MISUSE OR HAZARD
After the notification of the owner or the custodian of the property, if the client will not stop causing damage, danger or inconvenience to neighbors or fellow residents, Tupasluikka has the right to cancel the booking immediately. All the expenses caused from the actions mentioned above, will be charged from the client.
COMPLAINTS
Any objections and complaints regarding the cottage must be made immediately once the cause for them arises and addressed to the owner or custodian of the property direct. The matter will be satisfactorily attended to without delay.
APPLICABLE LAW AND VENUE FOR THE RESOLUTION OF DISPUTES
The contracting parties will attempt to resolve any disputes out of court. Should they fail to reach agreement, any disputes will be settled by the Tampere District Court. The contract is governed solely by Finnish law.
RIGHT TO CHANGE PRICES
Tupasluikka reserves the right to correct any errors in the price list before a rental agreement is made. Once an agreement is made, Tupasluikka has the right to raise and a corresponding obligation to reduce the agreed price if any changes in the taxes or public charges affecting the price of the holiday service
